The US Justice Department has entered the fray in a legal challenge initiated by California Republicans, seeking to prevent the California's newly approved electoral boundaries.
This legal action, submitted to federal court, challenges the redistricting plan championed by Governor Gavin Newsom, which was developed in reaction against a Republican-led gerrymander in Texas.
"The state's redistricting scheme represents a blatant attempt to seize control that violates civil rights and mocks the democratic process," stated the US attorney general.
The Democratic party have expressed confidence that the redistricting plan will withstand court challenges.
"The plaintiffs were defeated in the election and they are likely to also lose in court," stated a spokesperson for Governor Newsom.
Legal Basis
The legal challenge asserts that California's map improperly used racial considerations to significantly advantage Latino communities in violation of the federal constitution.
"Race cannot be used as a proxy to advance political interests, but that is exactly what the state legislature did with Proposition 50," argued a senior official from the DOJ's civil rights unit.
Political Context
The legal battle represents the major counterpunch by the Democratic party in the continuing redistricting war that started with Texas and has spread across multiple states.
In contrast to elsewhere, where Republican state legislatures have implemented partisan maps, California's plan required voter approval, which it received with approximately two-thirds of the vote.
Wider Consequences
The Democratic party need to gain just a handful of Republican-held House seats to gain majority of the chamber in next year's midterm election.
The political group controlling the controlling share will influence the final years of the current administration, deciding if a GOP-controlled legislature will continue to deliver its political program or encounter opposition, investigations and possible additional obstacles.
